Privacy Policy

1.    DEFINITIONS


1.1    Controller or Moris - Moris Spółka z ograniczoną odpowiedzialnością with its registered office in Chorzów (41-503), ul. Wiejska 27, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Katowice-Wschód in Katowice, VIII Economic Division of the National Court Register under KRS No. 0000407187, NIP 6462926930, REGON 242812590, with the share capital of PLN 46,000,000.00.
1.2    Cookies - computer data, recorded and stored on your device during the process of using the Web pages on the Internet, used for optimizing and identifying that process and collecting associated statistical data.

1.3    Personal Data - all information about a natural person identified or identifiable by one or more specific factors that determine physical, physiological, genetic, mental, economic, cultural or social identity, including - if they allow to identify you - the device IP, location data, online ID and information collected using cookies and other, similar technologies.    

1.4    Policy - this Privacy Policy.    

1.5    GDPR - Regulation 2016/679 (EU) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC,

1.6    Store - the Controller's online store available through the Website, through which Moris sells goods remotely.    

1.7    User - any natural person visiting the Website or using one or more services or functionalities of the Website.    


2.    PERSONAL DATA PROCESSED


2.1    The personal data to be processed is information directly related to the purchases made in the Store, which makes it possible to process the orders placed. Thus, Moris primarily processes: full name (business name), email address, telephone number, address of residence (business address or registered office), delivery address, method of payment.    

2.2    Information about the method of using the Store is also processed such as, in particular, device IP, location data, Internet ID, information collected using cookies.
 The Controller uses session cookies, i.e. files stored on your device until you log out or leave the Store, and permanent cookies, i.e. files stored on your device until they are deleted by you or until the cookie expires within the period specified in its specification.    

3.    MANNER AND PURPOSE OF PROCESSING PERSONAL DATA


3.1    You provide the Controller with your Personal Data voluntarily, however, it is required in order to place an order and make a purchase.    

3.2    You agree to share your Personal Data in order to create an account in the Store, log in to your account, use the contact form, create, execute and handle complaints concerning your order, including the conclusion of the agreement and payment. The Controller collects and processes your data to the extent necessary to provide the service chosen by you.    

3.3    A User account in the Store must be created in order to be able to place orders. To create an account, you must fill in the registration form.     

3.4    Moris processes cookies in order to verify statistics on how the Store is used, as well as to ensure stability of operation and security of the Store and Users. Cookies are not used for identifying you and your identity will not be established on their basis.    

3.5    By using the Store, you consent to the Controller's processing of the cookies necessary for this purpose, i.e. files with data entered by you for the duration of the session, authentication files for the duration of the session and files used for ensuring security for the duration of the session.    

3.6    You may consent to the Controller's processing of functional cookies that facilitate the use of the Store, i.e.: files that personalize your interface for the duration of the session and files that monitor website traffic. This consent may be revoked at any time.    

3.7    You will also have the right to consent to marketing cookies, allowing the delivery of advertising content, among other things, in connection with targeting Users with behavioral advertising.     The consent may be revoked at any time.    

3.8    At any time of using the Store, you can change the rules in which cookies are used on their device by selecting the appropriate option in the settings of the Internet browser they use.
 At the same time, the Controller stipulates that complete blocking of cookies, including those indicated in point 3.4, may result in the inability to register or log in to an account in the Store, and consequently in the inability to place an order and make a purchase.    

3.9    The Store website may contain links to other websites. Moris indicates that the Policy applies only to the Store, and suggests that you read the privacy policies of the websites to which you are redirected.    


4.    LEGAL BASIS AND DURATION OF PERSONAL DATA PROCESSING


4.1    The personal data necessary:

a)    for exercising the legitimate interests of the Controller or a third party 
(including, in particular, for presenting behavioral advertising, profiling, displaying marketing content to you, conducting satisfaction surveys, detecting and eliminating fraud) is processed by Moris on the basis of Article 6(1)(f) in conjunction with Article 6(1)(a) GDPR.
b)    for providing access to the website, is processed by Moris on the basis of Article 6(1)(b) GDPR;
c)    for performing legal obligations is processed by Moris on the basis of Article 6(1)(c) GDPR;    

4.2    Personal data is processed until the Store account is deleted. After its deletion, Moris will be entitled to process Personal Data until the statute of limitations for claims, completion of civil, enforcement, administrative and criminal proceedings that require data processing, as well as for the period provided for fulfillment of the obligations under the laws on defense, state security and public safety and order, as well as tax and accounting regulations.    

4.3    In the case of giving consent, the Controller will process the data until the consent is revoked or until the purpose for which it has been given, expires.    


5.    TRANSFER OF PERSONAL DATA, INCLUDING OUTSIDE THE EUROPEAN ECONOMIC AREA    


5.1    Your personal data may be transferred to entities that provide the Controller with services necessary for the purposes of processing. In particular, these include delivery, courier, postal, tax, legal, consulting, technical, hosting and IT companies, as well as advertisers. With your consent, this will also include companies that deal with content personalization and statistics.    

5.2    Your personal data may be transferred to countries/international organizations outside the European Economic Area, where such entities have been recognized with a decision of the European Commission as providing an adequate level of protection of personal data to the degree of protection in effect in the European Economic Area, or subject to application of appropriate safeguards, which may consist in using binding corporate rules, standard data protection clauses adopted by the European Commission, standard data protection clauses adopted by the President of the Polish Personal Data Protection Office, or contractual clauses permitted by the President of the Polish Personal Data Protection Office.


6.    USER RIGHTS    


6.1    In connection with the processing of your Personal Data, you have the right:

a)    to grant and revoke consent for data processing at any time,
b)    to rectify data,
c)    to have access to data,
d)    to have data erased,
e)    to limit data processing,
f)    to transfer data, 
g)    to object to the processing of data on the basis of the legitimate interest of the Controller or a third party for reasons related to the particular situation or to the processing of data for direct marketing purposes,
h)    to submit a complaint regarding the processing of Personal Data to the President of the Polish Personal Data Protection Office.

6.2    You can exercise the rights listed in point 5.1(a) - (g) above by contacting Moris in writing at the address: ul. Wiejska 27, 41-503 Chorzów, or using means of direct long-distance communication at the email address: rodo@moris.pl.

6.3    A complaint regarding the processing of Personal Data must be submitted directly to the President of the Polish Personal Data Protection Office - ul. Stawki 2, 00-193 Warszawa, with description of the situation and indication of the act violating your rights or freedoms.


7.    CURRENT VERSION AND AMENDMENTS TO THE POLICY    


7.1    The current version of the Policy has been adopted and is effective as of 5 December 2022

7.2    In order to securely process personal data and ensure high standards of data protection, Moris monitors and reviews the provisions of the current Policy on an ongoing basis. If necessary, it is updated immediately. Any and all the amendments will be effective only for the future. We encourage you to visit the Moris website regularly.
